These Terms and Conditions govern your use of Peridale's services and website. By booking a tour or using our services, you agree to be bound by these terms. Please read them carefully before making a booking.
1. Definitions
- "Company," "We," "Us," "Our": Refers to Peridale, the tour operator
- "Guest," "You," "Your": Refers to the person booking or participating in tours
- "Services": Highland tea tours, transportation, accommodation arrangements, and related activities provided by Peridale
- "Agreement": The contract formed when we confirm your tour booking
- "Tour": Any guided experience, excursion, or package offered by Peridale
2. Acceptance of Terms
By booking a tour through our website, email, phone, or other means, you confirm that:
- You are at least 18 years of age and have legal capacity to enter into this agreement
- You have read, understood, and agree to be bound by these Terms and Conditions
- All information you provide is accurate and complete
- You have authority to make bookings on behalf of other participants in your group
3. Booking and Confirmation
3.1 Booking Process
Tour bookings can be made through our website contact form, email, or phone. A booking becomes confirmed when we send written confirmation and payment has been received according to our payment terms.
3.2 Availability
Tour availability is subject to change. We reserve the right to decline bookings if tours are fully booked or if weather conditions or other circumstances make safe tour operation impractical.
3.3 Minimum Group Size
Tours may have minimum participant requirements. If minimum numbers are not met, we may offer alternative dates, a different tour, or a full refund of amounts paid.
4. Payment Terms
4.1 Pricing
All prices are listed in Malaysian Ringgit (MYR) and include stated tour components. Prices are subject to change without notice until booking is confirmed.
4.2 Payment Schedule
Payment terms depend on booking timing:
- Bookings more than 30 days before tour date: 50% deposit required, balance due 14 days before tour
- Bookings 14-30 days before tour date: Full payment required at booking
- Bookings less than 14 days before tour date: Full payment required at booking
4.3 Payment Methods
We accept bank transfers and major credit cards through our secure payment processor. Payment processing fees, if any, are included in tour prices.
5. Cancellations and Refunds
5.1 Guest Cancellations
Cancellation fees apply as follows:
- More than 30 days before tour: Full refund minus 10% administrative fee
- 15-30 days before tour: 50% refund
- 7-14 days before tour: 25% refund
- Less than 7 days before tour: No refund
5.2 Peridale Cancellations
We may cancel tours due to insufficient bookings, weather conditions, safety concerns, or circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule to an alternative date.
5.3 No-Shows
Failure to arrive at the designated meeting point or join the tour without prior notice constitutes a no-show and no refund will be provided.
6. Guest Responsibilities
As a tour participant, you agree to:
- Arrive at designated meeting points on time
- Follow instructions from guides regarding safety and tour conduct
- Inform us of any medical conditions, mobility limitations, or dietary requirements that may affect tour participation
- Behave respectfully toward guides, other guests, estate staff, and local communities
- Respect private property and follow estate rules when visiting tea plantations
- Not engage in behavior that may endanger yourself, other guests, or damage property
- Provide emergency contact information for multi-day tours
7. Health and Safety
7.1 Fitness Requirements
Tours involve walking on uneven terrain and may not be suitable for individuals with certain mobility limitations. Please contact us to discuss specific requirements before booking.
7.2 Medical Conditions
You must disclose any medical conditions that may affect your ability to participate safely. We reserve the right to refuse participation if we determine a health risk exists.
7.3 Insurance
We strongly recommend obtaining travel insurance covering medical expenses, trip cancellation, and personal liability. Our services do not include insurance coverage.
8. Limitation of Liability
8.1 Service Provision
We act as an organizer for tours and work with third-party service providers including accommodations, transportation companies, and estates. While we select partners carefully, we are not liable for their acts, omissions, or failures.
8.2 Liability Cap
Our total liability for any claim arising from tour services is limited to the amount you paid for the tour, except where prohibited by law.
8.3 Excluded Damages
We are not liable for indirect, consequential, or punitive damages including lost profits, lost time, or emotional distress, except in cases of gross negligence or willful misconduct.
8.4 Force Majeure
We are not liable for failure to perform services due to circumstances beyond our reasonable control including natural disasters, weather conditions, political unrest, strikes, or other force majeure events.
9. Intellectual Property
All content on our website including text, images, logos, and tour descriptions is owned by Peridale or licensed to us. You may not:
- Copy, reproduce, or distribute our content without written permission
- Use our name, logo, or branding for commercial purposes
- Modify or create derivative works from our content
You retain rights to photos and content you create during tours, though we may request permission to use guest photos for promotional purposes with appropriate credit.
10. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to such processing and warrant that all data you provide is accurate. Please review our Privacy Policy for details.
11. Changes to Tours
We reserve the right to make minor changes to tour itineraries due to weather, estate availability, or operational considerations. We will notify you of significant changes. If changes substantially alter the tour character, you may cancel for a full refund or accept the modified tour.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by Malaysian law. Any disputes arising from these terms or tour services shall be subject to the exclusive jurisdiction of Malaysian courts in Penang.
13. Dispute Resolution

14. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them enforceable.
15. Changes to Terms
We may update these Terms and Conditions periodically. Changes take effect upon posting to our website. Your continued use of services after changes indicates acceptance of modified terms. Bookings made before changes remain subject to terms in effect at the time of booking.
